Kennedy Agyapong, Assin Central MP and Boss of Kencity Media

Kennedy Ohene Agyaponf, member representing Assin Central Constituency in Parliament has appealed to the Supreme Court to set aside the decision by High Court Judge, Justice Amos Wuntah- Wuni to preside over his contempt case.

Kennedy, raising a red flag, faulted the decision by Justice Wuntah-Wuni of the Lands Court 12 to invite him to come to justify why he (Kennedy Agyapong) should not be punished for his scurrilous attacks on the court.

Justice Amos Wuntah-Wuni had summoned to appear before him to explain why he should not be thrown into prison for contempt on Monday 14 September 2020.

Kennedy did not show up for the hearing, claiming he had not personally been notified of the date for his appearance because he was not served.

Surprisingly, Kennedy Agyapong who was expected in court tomorrow to demonstrate why he should not be punished has filed certiorari at the Supreme Court to quash to restrain Judge Wuntah-Wuni from hearing the case.

Kennedy argued that the Justice Wuntah-Wuni was in error when he decided to preside over the contempt case.

He prayed the Supreme Court to quash the contempt summons issued by Justice Wuntah-Wuni.

He insisted that Justice Wuni was not the Judge he attacked, saying his insults and attacks were directed at Justice Frank Rockson and it should only be Justice Rockson’ Court that should hear the contempt application and not Wuni Wunta’s Court.

Social Media have described the action by the Assin Central Lawmaker as a calculated attempt to impede and delay the process of administering justice because Kennedy Agyapong and his Lawyers knew the court is on vacation.

Agyapong’s invitation to appear before the Court comes after the High Court’s (Land Court 12) attention was drawn to a television (NET2 TV) and Radio (Oman FM) program aired on September 2, this year.

Many Law Scholars including venerable Atta-Akyea, Prof. Azaar have all argued in the past that it was wrong for a Judge to preside over a contempt case in which he or she is directly involved.

Justice Wuntah-Wuni’s decision is not a novelty, because the two panelists and the host in the ‘Montie 3’ trial did not attack any of the Judges that sat on their trial.

It would be remembered that they were accused of attacking Chief Justice Georgina Theodora Wood, and not Justice Sophia Akuffo that chaired the panel that sent them to prison.
