The Chief Judge has relayed a directive from the Attorney General to all judges, especially lower court judges, regarding the handling of cases by police prosecutors. Dated March 4th, 2024, the directive underscores changes in the jurisdiction of police prosecutors in relation to the monetary value of cases they can handle.

According to Justice Torkonoo’s communication to all judges, the Attorney General’s Office has issued a directive concerning the prosecutorial limits of police prosecutors. Per this directive, police prosecutors are now tasked with prosecuting cases involving monetary values not exceeding GH¢500,000.00 (Ghanaian Cedi). Cases surpassing this monetary threshold must be referred to the Office of the Attorney General for further examination and advice.

I write with reference to the attached letter from the Office of the Attorney-General and Ministry of Justice dated 7th February, 2024, on the above-mentioned subject.

The Attorney General, by the said letter, is notifying the Service that Police Prosecutors have been directed to prosecute cases with a monetary value not exceeding the amount of GH¢500,000.00. The letter further indicates that any case with a monetary value above this limit must be referred to the Office of the Attorney General for study and advice. You are kindly requested to take note accordingly.”
